  My sales transaction involved 3 sellers, of which I was one. This seemed to be a challenge for the escrow company from the outset, but I would think this is a regular occurance. The proceeds here where to be split 50%, 25% and 25%. After the transaction closed, instead of sending each seller a 1099 for money they received, A-One Escrow sent everyone a 1099 for the entire proceeds. This will cause us all to be audited according to my CPA tax preparer. For myself, I'm assuming they sent me a 1099 for the entire proceeds, as that's what they did with the other two sellers, but for myself I never received any 1099 whatsoever. They also did not issue me a "Real Estate Withholding Statement" for the Franchise Tax Board, which is supposed to be done within 20 days following the end of the month the transaction completed. When I called them to inquire about these issues, Cathy Rutten was extremely rude and stand-offish. She refused to acknowledge that there could be an error on the 1099, she refused to correct it and refused to send me a copy. With regards to the withholding statement, she said "I might not have got it because she might not done it yet." I was trying to be as nice as possible, but she turned downright rude and hostile. She refused to do anything and demanded that if I want anything, I should put it in writing and send her $35.00 file retrevial fee. There is absolutley no doubt in my mind that they made a mistake on the 1099's (I'm an attorney who knows, at least, a little something about taxes, not to mention my CPA who is a tax professional). I asked them nicely to fix it and they (Cathy Rutten) not only refused, but were down right nasty about it. It has been over 6 months since this escrow closed and, as of today, I still have never received my closing statement.
